Welcome to Bingo Wireless ("Bingo eSIM", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and eSIM services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

IMPORTANT: By purchasing an eSIM from Bingo Wireless, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms constitute a legally binding agreement between you and Bingo Wireless.

1Acceptance of Terms

By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Your continued use of the Services after any changes constitutes acceptance of the new Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2Description of Services

Bingo Wireless provides prepaid eSIM (embedded SIM) data services for travelers visiting various destinations worldwide, with a focus on the Caribbean, North America, and Latin America. Our Services include:
  • Sale and delivery of prepaid eSIM data plans
  • Digital delivery of eSIM activation codes via QR code
  • Account management and order history
  • Customer support via email, chat, and WhatsApp
  • Data top-up services for eligible eSIMs

3Eligibility Requirements

To use our Services, you must:
  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have a compatible, carrier-unlocked device that supports eSIM technology
  • Have a valid payment method accepted by our platform
  • Provide accurate and complete information during registration and purchase
  • Not be prohibited from using the Services under applicable law

4Account Registration

To access certain features of our Services, you may need to create an account. When creating an account, you agree to: • Provide accurate, current, and complete information • Maintain and promptly update your account information • Keep your login credentials confidential and secure • Notify us immediately of any unauthorized access • Accept responsibility for all activities under your account We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5Device Compatibility

Before purchasing an eSIM, you are responsible for verifying that your device: • Supports eSIM technology (embedded SIM) • Is carrier-unlocked and not restricted to a specific network • Meets the technical requirements for eSIM installation • Is compatible with the network frequencies of your destination We provide a compatibility checker tool, but ultimate responsibility for compatibility lies with the customer. Refunds will not be issued for purchases made for incompatible devices if the customer did not verify compatibility beforehand.

6Pricing and Payment

All prices displayed on our website are in US Dollars (USD) unless otherwise specified. Prices include applicable taxes where required by law. Payment must be completed at the time of purchase using one of our accepted payment methods. We accept major credit cards (Visa, Mastercard, American Express), debit cards, and digital wallets (Apple Pay, Google Pay). We reserve the right to modify prices at any time without prior notice. Price changes will not affect orders that have already been completed.
  • All sales are final once the eSIM QR code has been delivered
  • Promotional codes and discounts cannot be combined unless explicitly stated
  • Currency conversion fees may apply based on your payment provider

7eSIM Activation and Validity

Upon successful payment, you will receive an eSIM activation QR code via email. The eSIM activation process is your responsibility. IMPORTANT TIMING INFORMATION: • The validity period of your data plan begins when you activate the eSIM on your device • Some plans may begin validity upon first data connection in the destination country • Once activated, the plan cannot be paused, extended, or transferred • Validity periods are measured in calendar days, not 24-hour periods Please activate your eSIM only when you are ready to use it. We recommend installing (but not activating) your eSIM before traveling.

8Refund Policy

Our refund policy is designed to be fair while protecting against fraud:
  • Full refund: If the eSIM cannot be provisioned due to a technical error on our end
  • Full refund: If the order is canceled before the QR code is delivered
  • Partial refund: If the eSIM fails to work due to coverage issues (case-by-case basis)
  • No refund: Once the QR code has been viewed, downloaded, or the eSIM has been installed
  • No refund: For incompatible devices if compatibility was not verified before purchase
  • No refund: For unused data or early plan termination by the customer
  • No refund: For service interruptions caused by third-party carrier issues

9Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
  • Use the Services for any illegal or unauthorized purpose
  • Resell, redistribute, or commercially exploit eSIMs without authorization
  • Share eSIM activation codes with third parties
  • Attempt to circumvent data limits or validity periods
  • Use the Services to send spam, malware, or malicious content
  • Interfere with or disrupt the integrity of our Services or networks
  • Attempt to gain unauthorized access to our systems or data

10Intellectual Property Rights

All content on our website and Services, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of Bingo Wireless or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The Bingo Wireless name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Bingo Wireless. You may not use such marks without our prior written permission.

11Service Availability and Coverage

While we strive to provide reliable service, we cannot guarantee: • Continuous, uninterrupted access to our website or Services • Network coverage in all areas of a destination country • Specific network speeds (4G/5G availability varies by location) • Compatibility with all applications or services Mobile network coverage depends on local carrier infrastructure and may be affected by factors outside our control, including terrain, weather, network congestion, and carrier maintenance.

12Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE ARE NOT RESPONSIBLE FOR THE QUALITY, COVERAGE, OR AVAILABILITY OF THIRD-PARTY CARRIER NETWORKS.

13Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINGO WIRELESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, data, use, goodwill, or other intangible losses • Damages exceeding the amount paid by you for the Services • Any damages arising from service interruptions, network outages, or carrier issues SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14Indemnification

You agree to indemnify, defend, and hold harmless Bingo Wireless, its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: • Your use or misuse of the Services • Your violation of these Terms • Your violation of any third-party rights • Any content you submit or transmit through the Services

15Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Juan, Puerto Rico, and you consent to personal jurisdiction in such courts.

16Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at info@bingowireless.net. We will attempt to resolve the dispute within 30 days. If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in San Juan, Puerto Rico, in English or Spanish at your choice. YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS.

17Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by: • Posting the updated Terms on our website • Sending an email to registered users • Displaying a notice on our website or app Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

18Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
